It is not really that difficult, as many states and localities have figured out. Just pass a law at the federal level treating employers who repeatedly hire illegals the same as, oh I don't know, say... marijuana growers and the problem will be solved. No

It wouldn't surprise me in the least to have this case go up on appeal to the Court of Appeals and the Supreme Court and have more conservative legal minds have a whack at overturning it.
