In the final chapter of a North Carolina "Greek Tragedy" was written last Friday with the fining and sentencing to one day in jail of former ""Duke Lacrosse Rape Case" prosecutor Mike Nifong.

Mr. Nifong, the recently disbarred former DA who prosecuted the case against several Duke University lacrosse players for rape, despite evidence to the contrary, was charged with criminal contempt of court for lying to a judge about DNA evidence.

Mr. Nifong stated he did not intentionally mislead the court over evidence from a private lab which showed DNA from multiple men, none of whom were the accused, were found in the 'victim.' A judge disagreed, and found Nifong guilty of criminal contempt and sentenced him to one day in jail (out of a maximum 30) and a $500 fine. Of course, Nifong's punishment is much more severe than the results of most prosecutorial misconduct cases around the nation.

Thomas Metzloff, a Duke University Law professor, called the verdict "unprecedented." He stated "This just doesn't happen. This was a very important moment because it showed that the court system really cared about what happened in this case."

You mean he spent less time in prison than Paris Hilton and all he did was try to ruin several lives?

Pshaw,  this is a VERY merciful justice system when they are asked to police their own.  

Just saying, IF the Duke Lacross players were convicted on this weak case, d'ya think Nifong may have advocated a 1 day sentence for any of these kids?  I don't.  

Prosecutorial misconduct, a very minor felony, with a max punishment of 30 days.  Every prosecutor in the country be put on warning, if you abuse your power to gain political advantage and try and ruin several lives on your own quest for self aggrandisement, you may end up seeing teh inside of a cell for a day.  

I guess they are lenient on prosecutors because they would probably have a harder time than most in prison.  That being said, 1 day in prison is a complete joke.  Nifong should spend the summer in the stocks in the quad at Duke University where students can come by and throw rotten tomatoes at him.

I, too, thought that line of logic was insane. They frequently toss people behind bars for years even though they are not a threat to anybody anymore and prison would be 'hard' for them (see Old Man Rigas). What Nifong did is arguably worse than other crimes which would get a day or two in jail, such as DUI and marijuana possession. And in contrast to "Smokey" down on the corner who got popped with some bud, Nifong's actions undermined the entire legal system and ruined several people's lives. He is a scum bag.

Does anybody know if they plan on bringing criminal charges against Crystal Gail Mangum? I, for one, strongly dislike people who fake rape accounts. Doing so should lead to immediate prosecution for perjury and filing a false report as it makes life difficult for those women who are actually sexually assaulted.

I want to know if that publicity pimp, Jesse Jackson, has written out any checks for her tuition yet.  I'm guessing not.  The next-to-last sentence in your second paragraph hits the nail on the head as to why Nifong deserved oh, so much more, than an overnight in the jail.  He took his authority and misused it to ruin people's lives and undermine everyone's respect for the criminal justice system.

Meh, I could care less what he does with his own private money as long as the media stops treating him as a credible spokesperson for any cause. The guy is a grade "A" Racebaiting Idiot.

    Same as it ever was, indeed. Oh, not that Nifong was punished- as the Slate article notes, he's the exception that proves the rule- but that a prosecutor was able, even encouraged, to charge off without a close examination of the case and the evidence. What's the explanation? (Not necessarily blame.) Ambition is noted, as is the adversarial nature of the legal system. I have my own culprit, though this may just be a pet cause: television cop shows.
     You've all heard the common elements of the stories: cops with their hands tied, prosecutors who don't have enough power, "technicalities" that let the obviously guilty go free, and so on. The very fact that these are stereotypes, banalities even, shows just how powerful they are, IMO. And while the reach from television to the real world may seem a stretch, ask yourself just what voters think when they hear a candidate is "tough on crime", and how much those opinions are shaped by the small screen-- and movies, too, like the Dirty Harry series, or the less glossy but still popular Death Wish series.
     Yet as Nifong showed quite well, a lot of this is bullshit; without the money and media exposure, the chances are quite good that those students would have ended up in jail, even given the same set of facts. While this should give every citizen pause the next time they hear a candidate or politician say they want to give the police more power, I'm not holding my breath.
    (Not the most original line of thinking, but as Samuel Johnson noted, folks need to be instructed less often than reminded.)

The only reason anything happened to Nifong at all because he made the mistake against some prissy white boys from Duke. If they'd been UNC lacrosse players, he'd still have a job with a slap on the wrist.

It is easy to buy small plaster models of what you think life is like.

Not so fast there, thefadd.  You're guilty of the same race baiting stereotyping that blew this puppy into a big to do from the get go.  The whole controversy was the white black thing, the "prissy white boys raped a black hooker" angle.  For you to say he only lost his job because of the race angle is dismissive of the WAY he did it.  He tried these boys in the media, making comments in over 50 seperate interviews, ruined their reputations and got them disciplined by their own college.  They were portrayed as having no scruples, as wild partying sex fiends and racists.  He pandered to the black electorate to get re-elected, playing up the race angle, luring in the shady characters like Jesse Jackson.  If he did the same thing at UNC it still would have been a massive scandal.  He still would have lost his job.  

Before making such a claim, I think there should be evidence to support that.  I don't believe Nifong had prosecuted any other gang rape cases where the accused were players of a college sports team.  

It wasn't the race of the accused or the victim that was the issue, it was the way Nifong played the race matter for his own purposes, playing the premature race card.  That and the fact that the rape never occurred.  Yeah knowing UNC, they may have been quicker to support their ahletes accused of a crime until the evidence came out.  But you never know.
