It sounds like something out of a crazy "tin foil hat" conspiracy theory. But it's true: under the guise of health testing for genetic birth defects the vast majority of babies born in this country now have their DNA stored in government banks for years, decades, or indefinitely, often without recourse.

A Western NY judge has ordered police and a prosecutor to her courtroom on Monday to explain themselves after following her orders. Last September the judge ordered police to obtain a DNA sample from Ryan Smith, a convicted criminal who was under suspicion for a crime spree that included kidnapping, shootings and a gas station robbery. The matter was simple enough until police used a taser to retrieve a DNA sample from an unconscious Smith.

Over two decades ago an 18 year old girl was raped. Police eventually found the man by his fingerprints, but the victim now believes the rapist's alleged reign of terror could have been halted early had his DNA been taken during one of his many trips to jail for minor offenses.
