Morally it might seem a mighty fine line, but for Robert Stevens of Pittsville, Virginia the fact there is a legal difference between treating animals cruelly and selling videos depicting animal cruelty makes a big difference - between 37 months in prison and freedom, to be exact. According to a panel from the US Third District Court of Appeals, the former is a crime and the latter a legitimate expression of free speech. In arriving at their 10-3 decision (pdf doc), they not only gave relief to Stevens, they also overturned a federal law regarding "creation, sale, or possession of animal cruelty."

Artists like to press the artistic envelope to see if they can emerge with a new definition of art. In doing so, artists will provoke and occasionally outrage us. But, if they're doing their job right, they are always asking us to question our preconceived notions of what art is. A pitfall for artists out on the envelope's edge is that they will emerge into areas which shock and outrage a public which believes isn't art. Such is the case of artist Guillermo Vargas and what he calls art and what others call animal cruelty.

One of the original 3 co-defendants in the Michael Vick dogfighting case has plead guilty to felony charges without any plea bargain or deal of reduced jail time, throwing himself on the mercy of the court and agreeing to testify against the NFL superstar.
