The death penalty is frequently criticized because only the poorest among us really risk dates with the executioner. It would stand to reason that the poorest can't afford to put on a first class defense. One state, following a painful experience with reversals of wrongful convictions, decided to make sure money wouldn't deter a vigorous defense when one's life is on the line. That state, Illinois, set up a pot of money those accused of capital crimes could tap to pay for their defense. Now it seems that this noble experiment in leveling the playing fields is tarnished as it was revealed that those who were supposed to be vigorously defending their clients were just as vigorously looting the taxpayer-provided defense fund.

The debate over whether lethal injection is a humane way of executing criminals is just about over. In most states, including Ohio, the path is clear to begin reducing the inventory of death row inmates. But, just like a bad cold the cruel and inhuman argument rears its ugly head again in Ohio as one profoundly overweight inmate says "I'm too fat to be put to death."

Delaware's method of executing prisoners is under court review in light of claims that lethal injection is neither humane nor painless. The US Supreme Court ruled earlier this year that lethal injection, at least as practiced in Kentucky, was not unconstitutional. There are still voices out there saying that lethal injection can be cruel and unusual punishment. Then there are the voices who say that lethal injection isn't nearly painful enough, considering what the person being executed had done. One of those voices served on the prison execution team which performed the last execution in Delaware, back in 2005. According to his deposition "he did not care if the execution caused Steckel unnecessary suffering or pain."

As the MPs (PDF), the FBI, and various talking heads chase the accused murderer of Lance Cpl. Maria Lauterbach, a new angle in the case may block the thirst for blood. The suspect is believed to have fled the country to Mexico, a nation which is among a growing list that refuse to extradite suspects back to face the death penalty.

A new report has been released by a special government commission in New Jersey fueling the debate over a punishment that has not been used since 1963. The report, coupled with the fact that the state has its first anti-death penalty governor since 1982 and a potentially sympathetic legislature could mean that NJ could soon become the 13th state without the sentence.
